This Privacy Policy describes how Service Day, Inc., a Minnesota corporation ("Service Day," "we," "us," or "our") collects, uses, shares, and protects your personal information when you use the Service Day platform (the "Platform"), including our website at myserviceday.com, our mobile application, and all related tools and services.

By using the Platform, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Platform.

This Privacy Policy is incorporated by reference into our Platform Terms of Service, our Customer Service Plan Agreement, and our Vendor Marketplace Participation Agreement.

1. INFORMATION WE COLLECT

1.1 Information You Provide

We collect information that you provide directly to us when you create an account, enroll in a Service Plan, register as a Vendor, or otherwise interact with the Platform. This may include:

  • Name, email address, and mailing address.
  • Phone number (optional for Customers; required for Vendors for operational purposes).
  • Payment information (processed and stored by Stripe; Service Day does not store full credit card numbers).
  • Information about your home systems and equipment (Customers).
  • Business information, insurance certificates, licenses, and background check certifications (Vendors).
  • Communications you send to us or through the Platform, including support requests and messages.
  • Ratings and reviews you submit.
  • SMS opt-in consent records, including timestamp, IP address, and consent version (if you enable SMS notifications).

1.2 Information Collected Automatically

When you access the Platform, we automatically collect certain technical information, including:

  • Device information (device type, operating system, browser type).
  • IP address and approximate geographic location.
  • Usage data (pages visited, features used, actions taken, timestamps).
  • Cookies and similar tracking technologies (session identifiers, preferences).
  • Referral source and search terms used to find the Platform.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Operate and maintain the Platform.
  • Facilitate connections between Customers and Vendors.
  • Process payments and manage billing through Stripe.
  • Schedule and coordinate Service Assignments.
  • Send transactional communications, including appointment reminders, service confirmations, and account notifications (via email through SendGrid and, if you opt in, via SMS through Twilio).
  • Administer the rating and quality system.
  • Respond to your inquiries and provide customer support.
  • Monitor and improve the Platform's performance, security, and functionality.
  • Comply with legal obligations and enforce our agreements.
  • Detect and prevent fraud, abuse, and unauthorized access.

We do not use your information for marketing or promotional purposes unrelated to our services.

3. SMS / TEXT MESSAGING PROGRAM

This section describes our SMS text messaging program in detail. If you have questions about the SMS program, contact us at support@myserviceday.com or reply HELP to any message.

3.1 Program Description

Service Day offers an optional SMS text messaging program that delivers transactional notifications related to your account and services. Messages may include:

  • Appointment reminders (three-day advance and day-of notifications).
  • New Vendor assignment notifications with accept/decline options (Vendors).
  • Service Plan change and approval notifications.
  • Custom service request status updates.
  • Rescheduling notifications and confirmations.
  • Monthly service summaries.
  • Account activity and security notifications.

The SMS program is strictly transactional. We do not send marketing, promotional, or advertising messages via SMS.

3.2 Opt-In Mechanism

Enrollment in the SMS program requires double opt-in:

  • Step 1 — Phone Verification: You verify your phone number by entering a six-digit verification code sent via Twilio Verify.
  • Step 2 — Explicit Consent: You explicitly enable SMS notifications by toggling the "SMS Reminders" setting to ON in your account settings at myserviceday.com/account. This toggle is OFF by default.

We record your consent with a timestamp, your IP address, and a consent version identifier.

Consent to receive SMS messages is not required as a condition of purchasing any service or using the Platform. You may use all features of the Platform without enabling SMS notifications.

3.3 Message Frequency

Message frequency varies depending on your account activity and role:

  • Customers: Approximately 0–4 messages per month, based on scheduled service visits and account activity.
  • Vendors: Approximately 0–15 messages per month, based on assigned Service Plans, scheduling changes, and account activity.

There is a daily cap of 20 messages per user. Actual message volume depends on your individual service schedule and account activity.

3.4 Costs

Standard message and data rates may apply. Service Day does not charge any additional fee for SMS notifications, but your mobile carrier's standard messaging and data rates will apply. Contact your carrier for details about your plan.

3.5 Opt-Out

You may opt out of the SMS program at any time using either of the following methods:

  • Reply by text: Reply STOP, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or STOPALL to any message from Service Day. You will receive a one-time confirmation that you have been unsubscribed.
  • Account settings: Toggle the "SMS Reminders" setting to OFF in your account settings at myserviceday.com/account.

After opting out, you will not receive any further SMS messages from Service Day unless you re-enroll. To resume SMS notifications, reply START to any previous message or re-enable the toggle in your account settings.

Opting out of SMS does not affect other communications (such as email notifications) or your use of the Platform.

3.6 Help

For help with the SMS program, you may:

  • Reply HELP to any message from Service Day to receive support information.
  • Email us at support@myserviceday.com.
  • Visit myserviceday.com/account to manage your SMS preferences.

3.7 Mobile Information Sharing

No mobile information, opt-in data, or SMS consent records will be shared with third parties or affiliates for marketing or promotional purposes.

Your phone number and SMS consent information are used solely for delivering the transactional messages described in this section and for the operational purposes of the Platform. We share your phone number with Twilio, our SMS service provider, solely to deliver messages on our behalf. Twilio is contractually prohibited from using your information for any purpose other than providing the SMS delivery service.

We do not sell, rent, lease, or trade your mobile phone number, SMS opt-in status, or any related consent data to any third party for any purpose.

4. HOW WE SHARE INFORMATION

We share your personal information only in the following circumstances:

4.1 With Vendors and Customers

To facilitate Service Assignments, we share limited information between Customers and assigned Vendors. Customers' names, service addresses, contact information, and Covered System details are shared with assigned Vendors solely for the purpose of performing scheduled Services. Vendors' business names, ratings, and relevant credentials are shared with Customers. Vendors are contractually prohibited from using Customer information for their own marketing purposes.

4.2 With Service Providers (Subprocessors)

We use the following third-party service providers to operate the Platform. Each processes data solely on our behalf and under contractual obligations to protect your information:

  • Stripe — Payment processing. Stripe processes and stores your payment information in accordance with PCI-DSS standards. Service Day does not store full credit card numbers.
  • Twilio — SMS text message delivery and phone number verification. Twilio processes your phone number solely to deliver transactional messages and verification codes on our behalf.
  • SendGrid — Transactional email delivery. SendGrid processes your email address solely to deliver service-related emails on our behalf.
  • Vercel — Application hosting and content delivery.
  • Neon — PostgreSQL database hosting and data storage.

4.3 For Legal Compliance

We may disclose your information when required to do so by law, regulation, legal process, or governmental request, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.

4.4 In Connection with Business Transfers

If Service Day is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transition, your information may be transferred as part of that transaction. We will notify you via email or through the Platform before your information becomes subject to a different privacy policy.

4.5 What We Do Not Do

We do not sell your personal information. We have never sold personal information and have no plans to do so.

We do not share your mobile phone number, SMS opt-in data, or SMS consent records with third parties or affiliates for marketing or promotional purposes.

We do not share your information with third parties for their own independent marketing purposes.

5. DATA RETENTION

We retain your personal information for as long as your account is active or as needed to provide you with services. After account closure, we retain your information as follows:

  • Account and transaction data: Retained for seven (7) years after account closure for audit, tax, legal compliance, and dispute resolution purposes.
  • SMS consent records: Retained for seven (7) years after the date of consent or opt-out to demonstrate compliance with applicable regulations.
  • Automatically collected data (logs, usage data): Retained for up to two (2) years for security monitoring and Platform improvement.
  • Communications and support records: Retained for three (3) years after the last interaction.

We may retain de-identified or aggregated data indefinitely for analytical purposes. When retention periods expire, we securely delete or anonymize your information.

6. DATA SECURITY

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Encryption of data in transit (TLS/SSL) and at rest.
  • Access controls limiting personnel access to personal information on a need-to-know basis.
  • Regular security assessments and monitoring.
  • Secure payment processing through PCI-DSS compliant providers (Stripe).

No method of electronic transmission or storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. If you become aware of any unauthorized access to your account, please contact us immediately at privacy@myserviceday.com.

7. YOUR RIGHTS

You have the following rights regarding your personal information:

  • Access: You may request a copy of the personal information we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete information.
  • Deletion: You may request that we delete your personal information, subject to legal retention requirements.
  • Data Portability: You may request a machine-readable copy of your data.
  • Opt-Out of SMS: You may opt out of SMS communications at any time as described in Section 3.5.

8. STATE-SPECIFIC PRIVACY RIGHTS

8.1 California (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including:

  • The right to know what personal information we collect, use, and disclose.
  • The right to delete your personal information.
  • The right to opt out of the sale or sharing of personal information. Note: Service Day does not sell personal information.
  • The right to non-discrimination for exercising your rights.
  • The right to correct inaccurate personal information.
  • The right to limit the use and disclosure of sensitive personal information.

8.2 Colorado, Connecticut, and Virginia

If you are a resident of Colorado (CPA), Connecticut (CTDPA), or Virginia (VCDPA), you have similar rights to access, correct, delete, and obtain a portable copy of your personal information. You also have the right to opt out of targeted advertising and the sale of personal data. Service Day does not sell personal data or engage in targeted advertising as defined by these laws.

8.3 Minnesota

If you are a Minnesota resident, you may have additional rights under Minnesota consumer protection laws, including the Minnesota Consumer Data Privacy Act (if and when effective). 9. CHILDREN'S PRIVACY

The Platform is not intended for use by anyone under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If we become aware that we have collected information from a child under 18, we will take steps to delete that information promptly. If you believe we have inadvertently collected information from a child, please contact us at privacy@myserviceday.com.

10. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will:

  • Post the updated Privacy Policy on the Platform with a new "Last Updated" date.
  • Notify registered users via email or through the Platform at least thirty (30) days before the changes take effect.

Your continued use of the Platform after the effective date of any update constitutes acceptance of the updated Privacy Policy. If you do not agree to any changes, you should stop using the Platform and contact us to close your account.
